The Federal Office of Administration is responsible for enforcing these regulations, as stipulated in Section 124 of the Administrative Offenses Act.

While using the iconic 'eagle' flags carries a risk of confusion with official state symbols and therefore potential penalties, an exception is made for major national events such as the European Championships. The domestic protocol allows the federal service flag or the one with the eagle coat of arms to be used in a 'socially acceptable' manner as an expression of national solidarity during such occasions. However, any misuse or devaluation of these flags is still strictly prohibited.

Football fans can safely wave the black, red, and gold flags without the eagle emblem, as their use is constitutionally protected. The primary concern arises with the lasting display of these flags on buildings or vehicles, which requires case-by-case legal approval. The rigidity of these regulations was highlighted by an incident in Darmstadt, where two soldiers were met with backlash for improperly hoisting the German flag at a Bundeswehr barracks.

On a lighter note, the DFB (German Football Association) has initiated a campaign encouraging fans to send in their custom flags, aiming to foster a vibrant atmosphere during the championship. Concurrently, football star Kylian Mbappé has expressed his anticipation for the tournament. In an interview with the German newspaper Bild, Mbappé discussed his eagerness to leave his mark on the event, a stark contrast to his previous performance at the Euro 2021 where he missed a crucial penalty.
