In a landmark decision, the US Supreme Court on Thursday upheld the conditions of access to mifepristone, a pill used in the majority of abortions in the United States. This latest judgment overturned an appeal decision that had reinstated a series of restrictions, ensuring that mifepristone remains available without additional constraints. The unanimous ruling indicated that the plaintiffs, anti-abortion associations composed of doctors and practitioners who do not prescribe or use the pill, lacked the necessary 'interest in acting,' a precondition for taking legal action. The Court thus annulled the previous appeal decision, which had reinstated several restrictions on mifepristone access and had already been suspended.

Previously, an appeals court reinstated multiple restrictions on mifepristone in 2023, which the FDA had lifted since 2016. These restrictions included reducing the limit of 10 weeks of pregnancy to seven, prohibiting mailing the pill, and requiring in-person prescriptions exclusively by a doctor. Judge Brett Kavanaugh, writing on behalf of the Supreme Court, stated that the plaintiffs failed to demonstrate any potential harm from the relaxed FDA rules, making federal courts unsuitable venues for addressing their concerns. Instead, he suggested they take their issues to the executive or legislative branches.

The June 2022 ruling annulling the federal guarantee of the right to abortion has given states the authority to legislate on abortion. Since then, nearly 20 states have banned or strictly regulated abortion, including mifepristone usage. President Joe Biden has emphasized protecting abortion rights as part of his campaign against his predecessor, Donald Trump. According to the Guttmacher Institute, nearly 63% of abortions in the United States in 2023 were performed using medication.

The latest ruling offers a reprieve to pro-abortion groups, safeguarding the unrestricted access to mifepristone. This judgment arrives nearly two years after the Supreme Court overturned Roe v. Wade, the precedent that had federally protected abortion rights for half a century. That pivotal decision allowed states to implement their own abortion laws, resulting in over 21 states banning or severely restricting the practice.

In the FDA vs. Alliance for Hippocratic Medicine (AHM) case, AHM had initially sought to prohibit access to mifepristone altogether. Their legal battle began in Amarillo, Texas, before Judge Matthew Kacsmaryk, whose ultra-conservative stance aligned with their objectives. The Fifth Circuit Court of Appeals, covering Texas, Louisiana, and Mississippi, accepted some of their arguments, restricting the FDA’s relaxed rules from 2016 and 2021 that had expanded access to the abortion pill through telemedicine and mail.

However, since the overturning of Roe v. Wade, the importance of mifepristone has increased, particularly in states where abortion access remains legal. FDA estimates indicate that more than five million women have used mifepristone over the past 20 years without significant health contraindications. The Supreme Court's recent decision underscores the significant ongoing legal and ethical battles over reproductive health and abortion rights in the United States.
