How to Handle a Found Smartphone Legally and Safely

Finding a lost smartphone can be a dilemma for many, but it is crucial to act within the boundaries of the law. According to Article 227 of the Civil Code of the Russian Federation, if you find a smartphone indoors or in transport, it should be handed over to the representative of the owner of that place. For instance, if you find a phone at a shopping center, you must report it to a security guard or a store employee. This step is essential to avoid any potential allegations of theft.

If the smartphone is found on the street and you cannot locate a police station, try to reach the owner directly. Even if the device is locked, you may be able to call back a missed call from the lock screen. If the owner contacts you, arrange a safe meeting to return the device.

In cases where you cannot reach the owner and the phone is off, experts advise against moving the SIM card to your device. This action could be dangerous for your phone or may lead law enforcement to suspect you of theft. Instead, it is recommended to file a report with the police.

Experts also warn about the potential risks associated with found smartphones. Sergei Kuzmenko, head of the Roskachestvo Digital Expertise Center, highlighted that some owners may deliberately prepare their devices for loss as part of fraudulent schemes. Found smartphones can harbor malware that may compromise your personal data, or worse, allow criminals to spy on you through the device's camera or microphone.

Additionally, there are cases where finders of lost phones face threats from criminals who may accuse them of theft or extortion, demanding money for the return of the device. Therefore, it is vital to consider all risks before deciding to keep a found phone. The safest course of action is to report the find to the police.

Roskachestvo emphasizes that keeping a found smartphone is legally considered theft under Article 158 of the Russian Criminal Code. However, if you report the find to the police and the owner does not claim it within six months, the phone can legally become yours.
