Human rights organizations, including the Coalition for Humane Immigrant Rights (CHIRLA), have decried the order as punitive and overly politicized. Angélica Salas, director of CHIRLA, emphasized that turning to restrictive measures to appease anti-immigration factions is 'wrong' and undermines the nation's long-standing commitment to being a haven for those in need. In a similar vein, 46 organizations signed a joint letter rebuking the policy, suggesting it harks back to the stringent policies of the Trump Administration rather than building a more equitable system.

Advocacy groups plan to challenge the order in court, citing Biden's campaign promises to reform the asylum system and promote humane policies. Erika Pinheiro, of Al Otro Lado, an organization with extensive experience on the border, criticized the arbitrary benchmark of 2,500 daily encounters. She warned that this threshold would not only prompt border closures but also lead migrants to take more perilous routes, heightening the risk to their lives.

The measure has also caused friction within Biden's own party. Senators like Chris Murphy and Alex Padilla have publicly questioned the constitutionality and efficacy of the executive order. Meanwhile, Republicans, including the governor of Texas, Greg Abbott, have dismissed the policy as a superficial attempt to salvage Biden's failing border security measures. Abbott termed it a 'smokescreen,' accusing the president of long denying the crisis at the border.
